2. Amendment to the Model Prisons and Correctional Services Act 2023 and the Prison Manual Rules 2016

Context: The Ministry of Home Affairs has amended the Model Prisons and Correctional Services Act 2023 and the Prison Manual Rules 2016.

The amendments are intended to comply with the Supreme Court’s judgment on caste-based discrimination against prisoners in the Sukanya Santha vs. UoI & Others case.

In this order, the Supreme Court also directed that the definition of habitual offenders in prison manuals should be per the respective State Laws.

Constitutional provisions against discrimination are Article 14 ( Equality before the law), Article 15 (Prohibition against discrimination), and Article 17 (Abolition of untouchability).
