3. Draft Digital Personal Data Protection Rules, 2025

Context: The Ministry of Electronics and Information Technology (MeitY) has released the Draft Digital Personal Data Protection Rules 2025 for public consultations. It will facilitate the implementation of the Digital Personal Data Protection Act of 2023 (DPDP Act 2023).

Key provisions of the DPDP Act 2023

  • Data Fiduciary: the entity that will determine the purpose and method of data collection.
  • Data Principal: the user whose data will be collected and processed.
  • Obligations of Data Fiduciary: Take user consent before personal data is collected and processed; children and disabled persons require the consent of parents or guardians. Appoint a Data Protection Officer (DPO) who will reside in India and act as the first point of contact for grievance redressal.
  • Rights of Data Principals: To get a summary from the Data Fiduciary of how their personal data is being processed, who has access to their data, etc.
  • Data Protection Board (DPO): Appointed by the Central Government, it has civil court powers for handling personal data breach complaints. Hence, statement 3 is correct.

Key points of Draft Rules

  • Users must be notified immediately in case of a data breach. The DPB requires prompt alerts and a full report within 72 hours. Hence, statement 1 is correct.
